Effective for All Custom Orders
At Patchgram, we value the trust our customers place in us when sharing their artwork, personal information, or proprietary designs. This Confidentiality Agreement outlines our commitment to safeguarding every aspect of your custom order. By placing a custom or personalized order with us, you acknowledge and agree to the following terms of confidentiality:
1. Scope of Confidentiality
- This agreement applies automatically to all custom and customized patch orders, without requiring a separate signed document.
- All information shared with us—including artwork, logos, sketches, references, names, personal details, and order notes—is treated as strictly confidential.
- This confidentiality covers:
- Digital artwork or design files
- Printed references or sketches
- Brand assets/logos
- Personal names or messages
- Customer personal information (email, address, phone, etc.)
- Any communication related to the custom order
2. Non-Disclosure of Customer Designs
- We will never share, publish, reproduce, or display any customer-provided design, production preview, or finished custom patch without explicit written permission from the customer.
- We do not use customer artwork for marketing, promotion, or portfolio showcases unless granted approval.
- All design drafts, embroidery files, production sheets, and digital proofs remain private.
3. Data Privacy & Security
- All customer data is stored securely and accessed only by authorized personnel involved in the production of the order.
- We do not sell, trade, or share customer information with any third party under any circumstances, except for logistics partners (e.g., FedEx) solely for shipping and delivery.
- Customers may request:
- Deletion of all their design files
- Removal of personal information
- A confirmation that no copies of their design remain on our servers or archive
We will honor such requests promptly.
4. Intellectual Property Protection
- All custom artwork provided by the customer remains the customer’s intellectual property.
- We do not claim ownership of any designs sent to us for customization or production.
- Embroidery files created from customer artwork are solely for the purpose of producing their patches and will never be reused for any other customer.
5. Internal Use Only
- Any employee, designer, digitizer, or production specialist handling your design is bound to internal confidentiality protocols.
- Your design is accessed only as necessary for completing your order.
- All unused or incomplete drafts are archived securely or disposed of safely.
6. Customer Rights
Customers have the right to:
- Request deletion of data
- Request copies of their design files
- Request a full privacy report
- Forbid us from storing long-term copies of their artwork
- Fully control whether or not their design is ever shown publicly
We comply with all such requests immediately.
7. Confidentiality Duration
This confidentiality agreement applies indefinitely, even after:
- The order is completed
- Files are delivered
- The working relationship ends
Your privacy remains protected permanently unless you explicitly state otherwise.
8. Exceptions
We may only disclose information if legally required to do so by law enforcement or court order.
Even in such cases, we will notify the customer whenever permitted by law.
9. Acceptance
By placing a custom order (or customizing an in-stock patch), the customer automatically agrees to this Confidentiality Agreement and all its terms.
